1. Information on out-of-court dispute settlements

We would like to inform you that in the event of a dispute between us and you as a consumer, you have the right to an out-of-court settlement, with the relevant body being the Czech Trade Inspection Authority (Česká obchodní inspekce), pursuant to Section §14 of Act. 634/1992 Coll., On Consumer Protection, as amended. 2. Information on Copyright Protection – Notice

All published information, photographs, articles, or advertisements placed on this website are protected by Act No. 121/2000 Coll., On Copyrights, as amended, Act No. 213/1995 Coll., On Trademarks, as amended, and other valid and effective legal regulations. You may copy this information for your personal use, but you may not publish or distribute the information, photographs, etc. without the prior written consent of SHARK AERO.

Some information published on this website is obtained from public sources; in case of damage caused by incomplete or incorrect information, SHARK AERO is not responsible for this damage.

3. Privacy policy of SHARK.AERO

(hereinafter referred to as the "Privacy Policy")

SHARK AERO needs the contact information you provide to us to contact you about our products and services. You may unsubscribe from SHARK AERO communications at any time. SHARK AERO is committed to protecting and respecting your privacy, and we’ll only use your personal information to administer your account and to provide the products and services you requested from us. From time to time, we would like to contact you about our products and services, as well as other content that may be of interest to you. In order to provide you the content requested, we need to store and process your personal data.

The data controller and processor of personal data is SHARK.AERO International, s.r.o. with a registered office at Thunovská 183/18, Malá Strana, 118 00 Prague 1, Identification number:03998967 (hereinafter referred to as the "Company").

We process the personal data of the data subject for as long as necessary, but no longer than five (5) years in accordance with the purpose for which they were obtained.

We obtain personal data on the basis of

  • the data subject's explicit consent via the Company's website;
  • the written (paper) explicit consent of the data subject;
  • in connection with and for the purposes of entering into and performing under a contract between the data subject and the Company.

Personal data obtained

  • pursuant to paragraph 2.1. of this Privacy Policy are processed exclusively for the purpose of sending commercial communications, to which the data subject also gives us consent;
  • pursuant to paragraph 2.2. of this Privacy Policy, we process for the purposes of performing an agency contract with a third party (e.g. a dealer), or for the purpose of providing services to third parties, always according to the need or agreement of the data subject who agrees to provide us with personal data to these third parties;
  • pursuant to paragraph 2.3 of this Privacy Policy, we process for the purpose of performing a contract (usually a sales contract) concluded between the data subject and the Company.

The Company takes care of the security of the personal data it receives from the data subject. The personal data of the data subject is not accessed by any unauthorized person and is not transferred without the consent of the data subject to other entities for further processing, unless required by law or in case of protection of the Company's legal interests.

The data subject has the right to ask the Company for information on what personal data about him/her and to what extent and for what purpose we process. The Company shall provide this information free of charge within a period of no more than thirty (30) days, and in exceptional situations within a period of no more than ninety (90) days. The data subject will be informed in due time of the extension of the time limit in exceptional cases. The Company shall have the right to verify the identity of the applicant and, if necessary, to request additional information to identify the applicant (e.g. a certified signature) before providing the requested information. The Company shall have the right to refuse requests for information that are unreasonable or unreasonably repetitive, or that require unreasonable effort to obtain, or that would be difficult to obtain (typically from back-up systems, archival records, etc.). In addition, the data subject has the right to request the Company to correct or delete personal data obtained on the basis of the consent given pursuant to paragraph 3 a. and b. of this Privacy Policy.

If the data subject has doubts as to whether the Company processes personal data in accordance with the applicable legislation of the Czech Republic and the European Union, he/she has the right to object and the Company will subsequently verify the validity of the request.

The data subject also has the right to object to the processing of personal data about him/her by the Company to the competent authority at the Office for Personal Data Protection, Pplk. Sochor 27, 170 00 Prague 7.

The data subject has the right to withdraw consent to the processing of personal data at any time and to request the deletion of the personal data recorded. The right to erasure does not apply to data processed in the context of the obligation to perform a contract, legal reasons (AML) or legitimate interests. If the data is stored in back-up systems that automatically ensure the resilience of all systems and perform the function of data loss protection in the event of accidents, it is not possible to delete the data even from the back-up systems, or it is not technically feasible. However, this data is not actively processed and will not be used for further processing purposes.

You may also address your data protection questions to sales@shark.aero  or to the registered office of the Company mentioned above, or as registered in the commercial register at the time.

The Company's website stores the following information: IP address, web page opened, http response code, browser and operating system identification, monitor resolution. This information is processed by the Company to optimize the website to improve the user experience and for the purposes of legal protection and legitimate interests. Furthermore, this data is stored in connection with the consent given for the processing of personal data and the sending of commercial communications, for the duration of the consent for the sole purpose of the Company's legal protection, without any further processing.

The Company's website uses technology to collect and store information using cookies on the data subject's device. Cookies are small text files that are not sent anywhere or otherwise processed. Cookies do not collect any of your personal information, but without these cookies we cannot provide the full functionality of the website. We use cookies to personalise content, ads and to analyse our traffic. We also share information about your use of our site with our advertising and analytics partners who may combine it with other information that you've provided to them or that they've collected from your use of their services

We use Google services that may associate activity on this website with information from users who are signed into their Google accounts. This may include interactions such as page views, clicks, or conversions being linked to Google user data for the purposes of analytics, advertising, and performance measurement. In accordance with Google’s policies, we ensure that appropriate consent is obtained from users: By using our website and consenting to our use of cookies and similar technologies, users agree to this data processing as described. This user data may be accessed and managed, including deletion, through Google’s “My Activity” feature available in their Google account settings.

4. Receiving commercial communication

In the event that you, as a visitor to this site, request information to be sent by SHARK AERO to your e-mail address, or you share your e-mail address with SHARK AERO for the purpose of obtaining information on the light aircraft market because you are considering an aircraft purchase, SHARK AERO is authorized to use this e-mail address to send commercial communication containing offers by SHARK AERO, provided that it complies with other conditions as required by law.

Commercial communication, in the sense of Act. No. 480/2004 Coll., On Certain Information Society Services, as amended, includes aircraft sales offers sent by e-mail.

The recipient of the commercial communication will always be able to withdraw his/her consent for the use of his/her electronic address (e-mail) for disseminating commercial communication in a simple way.

5. Email Communications and Email Tracking

If you choose to receive marketing communications from Shark Aero, we may send you emails containing news, product information, invitations to events, demonstration flight opportunities, customer stories and other information that we believe may be relevant to your interests.

To help us understand how our communications are performing and to improve the relevance of future emails, our marketing emails may use standard technologies such as tracking links and, where applicable, email tracking pixels. These technologies may allow us to determine, for example:

  • whether an email has been delivered;

  • whether links within an email have been clicked;

  • which pages on our website are visited after clicking an email;

  • whether content such as brochures, videos or other resources has been accessed.

Where email tracking pixels are used, they may collect limited technical information such as the date and time an email was opened, the IP address, approximate geographic location derived from the IP address, device type, operating system, email client and browser information. This information is used solely to measure the effectiveness of our communications, improve our marketing activities, personalise future communications where appropriate, and better understand the interests of prospective and existing customers.

Our primary interest is understanding meaningful engagement with our products and services, such as brochure downloads, demonstration flight requests, visits to aircraft model pages and other interactions that indicate genuine interest. We do not make automated decisions that produce legal or similarly significant effects based solely on email engagement.

Where required by applicable data protection or privacy laws, we will obtain your consent before using email tracking technologies. In other cases, where we rely on our legitimate interests, we will balance those interests against your rights and freedoms and implement appropriate safeguards.

You may unsubscribe from our marketing emails at any time by using the unsubscribe link included in every marketing email or by contacting us directly. Unsubscribing will stop future marketing communications but will not affect service-related or transactional communications that are necessary to fulfil our contractual obligations or respond to your requests.

You also have the right, subject to applicable law, to request access to your personal data, request its correction or deletion, object to certain processing activities, restrict processing, or withdraw any consent previously given. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.
